Question If I am an education provider, how do I apply to provide these services for loan officer registrant applicants and loan officer registrants?
Answer All education providers for loan officer pre-registration education and continuing education will need to apply and be approved by the commissioner.  The format to apply is available on the Office of Financial and Insurance Regulation website http://www.michigan.gov/documents/dleg/App-PEOnly7-17-084_245564_7.pdf.

Question What is the pre-registration education requirement for a loan officer registrant?
Answer
  • At least 24 hours of live classroom instruction in Michigan by an instructor approved by the commissioner.
  • Introductory course is in residential mortgage lending.
  • At least 3 hours of the live classroom instruction concerns state and federal laws and regulations governing residential mortgage lending, which content is approved by the commissioner.
 
Question What is the continuing education requirement for a loan officer registrant?
Answer
  • At least 6 hours of instruction in a course or courses relevant to the mortgage lending industry.
  • Of the 6 hours of instruction, at least 1.5 hours related to legal and regulatory compliance, and at least 1 hour related to ethics and fraud prevention.
  • May be conducted by a live instructor or may be conducted by electronic means (the internet, digital broadcast, or satellite network).  Course completion by a loan officer registrant must be confirmed if it is conducted by electronic means.
  • Course must be provided by a person approved by the commissioner.

       *  Continuing education will not be required in year 2009.

Answer You need to contact the approved education providers to obtain course costs and materials.
 
Question Who is the loan officer examination vendor?
Answer Pearson VUE is the vendor for the loan officer examination.
 
Question I've taken the 24 hour pre-registration education course.  How do I schedule to take the loan officer examination?
Answer Once you receive your approval notice from Pearson VUE, you may log into the Pearson VUE website www.pearsonvue.com(select Category - Real Estate, Appraisers, Mortgage & Loan; Program - Michigan Mortgage Loan Officer) or contact Pearson VUE at (866) 936-7781 to schedule an examination.
 
Question How do I obtain an approval notice from Pearson VUE so that I can take the loan officer examination?
Answer
  • Approved education providers are responsible for identifying any and all individuals who have completed an approved pre-registration education course.  Education providers must submit that information to Pearson VUE within five business days of an individual's course completion.
  • Pearson VUE will send an approval notice (via e-mail only) to the individual within two (2) business days after receiving this information from an approved education provider.
 
Question What information do I need to provide to the education provider in order to receive my approval notice from Pearson VUE?
Answer Individuals will be required to provide, at a minimum, the following information to their education provider:
  • first and last name
  • date of birth
  • the last four digits of social security number
  • contact information
  • a valid e-mail address
 
Question I did not receive an approval notice from Pearson VUE, who do I contact?
Answer If you do not receive an approval notice from Pearson VUE within seven (7) business days after completing your 24 hour pre-registration education course, please contact Pearson VUE at (866) 936-7781.
 
Question What score do I need to have to pass the examination requirement for loan officer registration?
Answer Individuals need to correctly answer at least 75% of the questions on the examination approved by the commissioner.
 
Question If my examination score is below 75%, can I retake the exam?
Answer Yes, you can retake the examination as many times as necessary to meet the 75% acceptable passing score.  You will need to reschedule a date and time to retake the examination and will need to pay the required examination fee again.
 
Question When can criminal history checks be conducted?
Answer A criminal history check may be conducted by the licensee or registrant, requested of and performed by the Michigan State Police and the FBI, at any time on or after January 1, 2009.
 
Question What is the criminal history check requirement?
Answer
  • Michigan State Police and the FBI shall perform the criminal history check.
  • The individual who is the subject of the criminal history check shall have his or her fingerprints taken by a law enforcement agency (if non-Michigan resident) or by L-1 Enrollment Services (if Michigan resident).
  • Pay the agency or person the fees required by the Michigan State Police and the FBI for processing fingerprints and completing a criminal history check.
  • Request that the agency or person forward the fingerprints, a request for a criminal history check of the individual in the format and as prescribed by the Michigan State Police, and the fees to the Michigan State Police.
  • Michigan State Police shall forward the fingerprints and appropriate fee to the FBI for a national criminal history check.
  • After receiving a proper request and the required fees, the Michigan State Police shall conduct the criminal history check and provide the licensee or registrant with the results of the criminal history check. The results shall contain any criminal history record information concerning the individual maintained by the Michigan State Police and the results of the FBI's criminal history check.
  • The licensee or registrant shall attest to the results of the criminal history check by completing and signing the Michigan specific application Form FIS 2080.
 
Question What convictions would deny a loan officer registration?
Answer The commissioner shall not issue a loan officer registration to any of the following:
  • An individual who has been convicted of, or pled no contest to, a felony or misdemeanor involving embezzlement, forgery, fraud, a financial transaction, or securities.
  • An individual who has been convicted of, or pled no contest to, within the 10 year period preceding the date of the application, a felony other than a felony involving embezzlement, forgery, fraud, a financial transaction, or securities.
 
Question If a loan officer resides in Michigan, how do they obtain a criminal history check?
Answer
  • The individual will have his or her fingerprints taken by L-1 Enrollment Services, a vendor approved by the commissioner.
  • L-1 Enrollment Services will scan the individual's fingerprints and submit the data to the Michigan State Police.
  • Michigan State Police will submit the data to the FBI and results will be sent back to the Michigan State Police.

Question If a loan officer resides in a state other than Michigan, how do they obtain a criminal history check?
Answer
  • The individual will have his or her fingerprints taken by a law enforcement agency on an FBI applicant card.
  • The complete FBI applicant card will be mailed to L-1 Enrollment Services, a vendor approved by the commissioner.
  • L-1 Enrollment Services will scan the FBI applicant card and submit the data to the Michigan State Police.
  • Michigan State Police will submit the data to the FBI and results will be sent back to the Michigan State Police.

Question Do I submit the results of the education, examination, and criminal history check to the Office?
Answer Paper results do not need to be submitted for a loan officer registration, but should be maintained by the licensee or registrant.  The Loan Officer Request for Registration and Michigan-Specific Supplement to Form MU4 (FIS 2080) will require the following:
  • Attestation that the loan officer registrant applicant has completed at least 24 hours of live classroom instruction in Michigan by an approved instructor.
  • Attestation the loan officer registrant applicant has correctly answered at least 75% of the questions on a loan officer examination.
  • Attestation that a criminal history check has been completed and the results do not contain a conviction or a pleading of no contest to a felony or misdemeanor involving embezzlement, forgery, fraud, a financial transaction, or securities.
  • Attestation that a criminal history check has been completed and the results do not contain a conviction or a pleading of no contest to a felony within the 10 year period preceding the date of the individual's loan officer application.
