Reservist's Reemployment Rights

 

Military reservists, including Michigan National Guard members, have reemployment rights guaranteed by both federal and state laws.

 

In a nutshell, reservists need to notify the employer of military duty requirements. The employer must grant the necessary time off. Upon completion of the military duty, the returning reservist is entitled to return to the job, or a similar job, with no loss in seniority or other accrued benefits. Employers and reservists should review the applicable laws to ensure compliance.

ESGR committees work with employers, reservists, and military leadership to build and maintain a strong base of support for the role of the National Guard and Reserve.

Small Business Reservist Economic Injury Loan


Small businesses that employ military reservists in key positions may be eligible for U.S. Small Business Administration (SBA) loans through the Military Reservist Economic Injury Disaster Loan program. The reservist must be an essential employee in a small business and the business must be unable to meet ordinary and necessary operating expenses due to the call-up to active duty of the reservist.
