Request a Variance from NTEP Requirements for Commercial Weighing and Measuring Devices

This policy implements the National Type Evaluation Program (NTEP) requirements currently in place in Michigan in accordance with P.A. 283 of 1964, as amended, the Weights and Measures Act. The policy addresses modifications of, upgrades to, and one-of-a-kind commercial weighing and measuring devices. All such devices must meet the current requirements of Handbook 44.

Exemptions from NTEP requirements may be requested in the following manner. A Worksheet for Variance Request must be completely filled out and submitted with all attachments (certificates of conformance, drawings, photographs, etc.) to:

All requests must be in writing and submitted by the owner of the device no later than 30 days prior to the start of the project (electronic copies are not accepted). A service agency may assist in the preparation of the request, however only requests submitted by the device owner will be processed. Inquiries or changes regarding a request must be made by the device owner. Requests involving an increase of the device capacity must include a letter from a competent authority (typically the device manufacturer) attesting to the safety of the proposed changes.
